Pharr man sentenced to 12 years for fatal drunk driving crash
A 25-year-old Pharr man pleaded guilty Friday to intoxicated manslaughter for killing a 51-year-old man in a car crash in 2021.
Damian Rodrigo Martinez was then sentenced to 12 years in prison for killing Juan Carlos Silva on April 24, 2021.
The crash happened about 3 a.m. at the intersection of Cage Boulevard and Javelina Drive, according to a probable cause affidavit.
Pharr police responded to the intersection for a major crash involving a black Dodge Charger and a gray Nissan Rogue.
While at the scene, police learned that Martinez, who was the driver of the Charger, got into a white Honda Civic and left the scene.
Police caught up with the Honda, conducted a traffic stop and saw that Martinez was in the back seat with blood on his pants and glass debris on him, according to the affidavit.
Once out of the vehicle, Martinez displayed signs of intoxication which included slurred speech, bloodshot eyes, and having a strong odor of alcohol on him.
“The defendant then stated on his own that it was on him and that he was going to take responsibility,” the affidavit said.
A charge of accident involving death against Martinez was dismissed. He’ll receive credit toward his sentence for a little more than the two years he spent in the Hidalgo County Adult Detention Center.
