Firearms charge lands McAllen man 5 years in prison

A 34-year-old McAllen man was sentenced to five years in federal prison after he pleaded guilty to possessing firearms as a felon, according to a U.S. Attorney’s Office news release.

David Michael Saenz was arrested on Sept. 11, 2024 after being stopped for a traffic violation in which authorities also smelled marijuana emitting from his vehicle.

Authorities also searched his vehicle after Saenz admitted to having firearms. During the search they found “two handguns in his waistband and two additional firearms in his vehicle,” stated the release.

They also found meth and marijuana within the vehicle.

Throughout their investigation authorities learned that Saenz had been previously convicted of aggravated robbery in 2021 and is prohibited from possessing a firearm due to being a convicted felon.

Saenz admitted to authorities that he was carrying one of the firearms to “protect himself while engaging in drug dealing,” stated the release.

He pleaded guilty on Nov. 21, 2024 and was sentenced Friday by Chief U.S. District Judge Randy Crane to 60 months in federal prison, which will be immediately followed by three years of supervised release.

Saenz will remain in custody pending his transfer to a Bureau of Prisons facility that has yet to be determined.
